1. Introduction and Acceptance of Terms

1.1.

These Terms of Use (the "Terms") govern your rights and obligations when accessing and using the websites, applications, APIs, dashboards, tools, and other services provided by NiamonX LTD (the "Company", "NiamonX", "We", "Service").

1.2.

Access to and use of the Service signifies that you:

  • have carefully read these Terms;
  • understand their content;
  • unconditionally agree to comply with them in full.

If you do not agree to these Terms, you must immediately cease using the Service.

1.3.

These Terms apply in addition to and in conjunction with:

  • Privacy Policy, including versions for the EU (GDPR), United Kingdom (UK GDPR), and USA (CCPA/CPRA);
  • applicable Data Processing Agreements (DPA), Service Level Agreements (SLA), and other separate contracts (if any).

In case of conflict between these Terms and individual written agreements with corporate clients, such individual agreements shall take precedence to the extent applicable to that specific client relationship.


2. Scope of Application

2.1.

These Terms apply to:

  • all users — individuals (B2C) and organizations (B2B);
  • all forms of access to the Service, including free and paid features, trial and beta versions, API, integrations, third-party clients;
  • any domains, subdomains, and interfaces controlled by NiamonX LTD.

2.2.

Special terms and agreements (such as DPA, SLA, separate commercial agreements) may supplement these Terms and govern relationships with specific corporate clients. In case of conflict with such documents, individual written agreements shall take precedence.


3. Geographic Restrictions and Sanctions

3.1.

Access to the Service is PROHIBITED:

  • from territories subject to sanctions by the European Union (EU), United Nations (UN), or US Office of Foreign Assets Control (OFAC);
  • from the territory of the Russian Federation, Islamic Republic of Iran, and Democratic People's Republic of Korea (North Korea, DPRK).

3.2.

Any attempt to circumvent these restrictions, including (but not limited to):

  • use of VPN, proxy, TOR, anonymizers, or other means of geolocation concealment;
  • use of remote hosting providers, servers, or intermediaries from prohibited territories;
  • creation and use of multiple accounts to mask access origin;

constitutes a material breach of these Terms and may result in:

  • immediate blocking of the account and all related accounts;
  • revocation of access to the Service and API;
  • cancellation of subscription without refund;
  • disclosure of information to competent authorities if required by law.

4. Registration, Account, and Security

4.1.

Access to most features requires registration and account creation. You agree to provide accurate, current, and complete information about yourself.

4.2.

You are fully responsible for maintaining the security of your account credentials (login, password, 2FA codes, access tokens) and for all actions performed under your account. Until we receive proper notice from you regarding account compromise, all actions performed using your account shall be deemed to have been performed by you.

4.3.

In case of suspected unauthorized access, password compromise, email compromise, or other authentication means, you must immediately notify us at: [email protected] or [email protected].

4.4.

Multiple accounts and creation of additional accounts for the purpose of:

  • bypassing geographic blocks;
  • bypassing rate limits or restrictions;
  • bypassing blocks, sanctions, or other measures imposed by NiamonX;

are strictly PROHIBITED and will result in blocking of all related accounts, subscription cancellation, and possible disclosure of information to competent authorities if required by law.


5. Age Restrictions

5.1.

Registration and use of the Service is permitted only to persons who have reached 18 years of age or the age of full legal capacity established in your jurisdiction (whichever is higher).

5.2.

If you are under 18 years of age, you are not permitted to register or use the Service. We reserve the right to delete or block accounts created by minors upon receiving relevant information.


6. Subscriptions, Payment, and Renewal

6.1.

Pricing plans are provided on a prepaid basis. Payment is processed through:

  • Stripe — for bank card payments (NiamonX does not receive or store full card details; Stripe acts as an independent controller for payment data processing — see Stripe Privacy Policy);
  • NOWPayments — for cryptocurrency payments (NOWPayments acts as an independent controller for payment data — see NOWPayments Privacy Policy).

6.2.

Subscriptions typically have a monthly billing period and automatically renew unless auto-renewal is disabled. Pricing plan terms and conditions are specified in the Service interface.

6.3.

Content, features, and tools included in the paid plan become available immediately after successful payment processing by the respective provider.

6.4.

Consumer Rights (for Consumers): By placing an order and completing payment, you:

  • expressly request immediate performance of the contract;
  • acknowledge and accept the loss of the 14-day right of withdrawal for digital content provided without a tangible medium, to the extent permitted by applicable consumer protection legislation.

If you do not agree to immediate performance and loss of withdrawal rights, you should not proceed with payment, and access to digital content may be delayed or not provided until expiration of the statutory period.


7. Cancellation and Refunds

7.1.

You may cancel your subscription at any time through the Service interface:
Settings → Bills and Plans → Manage Accounts, which will open the Stripe portal where you can manage your subscription and auto-renewal.

7.2.

After subscription cancellation, the Service continues to be provided until the end of the already paid period.

7.3.

Refunds for unused time are not provided, except in cases expressly provided by applicable law or a separate refund policy published by NiamonX.

7.4.

Refund requests are reviewed by the support department. The Company reserves the right to request additional information from you and to reject unreasonable or fraudulent requests.

7.5.

No refunds are provided as the Company incurs direct costs for server equipment, processor time, protection of your personal data, and payment to partners for services rendered. Only in exceptional cases decided by the legal department may a refund be issued with deduction of all payment system fees and costs incurred by the Company.


8. Service Availability and Technical Maintenance

8.1.

The Company strives to ensure high availability and stability, however:

  • does not guarantee 100% uptime;
  • does not guarantee absence of failures, errors, and delays.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

8.2.

We reserve the right to conduct scheduled and unscheduled technical maintenance, modernization, system and infrastructure updates, which may result in temporary partial or complete unavailability of the Service or individual tools.

8.3.

We are not liable for:

  • downtime caused by infrastructure or external provider failures;
  • connection problems caused by third-party networks or user equipment;
  • consequences of Service unavailability, except as expressly provided by applicable law.

9. Permitted Use

9.1.

You confirm that you:

  • have legal grounds for processing any personal data that you request, upload, or analyze through the Service;
  • have authority to assess the respective assets (e.g., acting on behalf of your organization or client with written authorization, or conducting lawful open research based on OSINT);
  • will use the results exclusively within the framework of applicable legislation, including data protection laws, privacy, financial regulations, cybersecurity, as well as criminal and administrative law.

9.2.

NiamonX tools are intended for:

  • cybersecurity, self-audit, and account protection;
  • professional investigations, risk assessments, and breach analysis;
  • legitimate OSINT research.

9.3.

The Service is NOT intended and MUST NOT be used for:

  • harassment, doxxing, threats, discrimination;
  • illegal monitoring or surveillance;
  • preparation, commission, or facilitation of unlawful activities.

10. Prohibited Actions

Without limitation, the following actions are strictly PROHIBITED:

10.1. Credential spoofing, unauthorized access to others' accounts, hacking, password brute-force attempts.

10.2. Doxxing, harassment, intimidation, or other forms of abuse against individuals or organizations.

10.3. Public disclosure of:

  • full credential dumps;
  • passwords, tokens, or detailed contact information of breach victims;
  • other confidential personal data (PII) obtained using NiamonX tools.

10.4. Resale, mirroring, mass downloading, or reproduction of NiamonX datasets, including breach data, OSINT aggregates, and service reports.

10.5. Large-scale benchmarking, mass data collection from the user interface (UI scraping), or API use beyond established limits, unless provided for by official agreements and conducted through approved access points.

10.6. Bypassing geographic blocks, sanctions restrictions, and other technical measures (VPN, proxy, TOR, multiple accounts, etc.).

10.7. Using Service output data for:

  • hacking attempts, vulnerability exploitation, phishing;
  • fraud, extortion, or other crimes;
  • any form of unauthorized access to third-party systems.

10.8. Any automation except that provided by the official API:

  • automated "clicking", browser scripts, headless browsers, crawlers, parsers — PROHIBITED unless specifically permitted by written agreement;
  • attempts to bypass request limits, rate limits, or quotas.

10.9. Creating new accounts to bypass:

  • plan limits;
  • data access restrictions;
  • blocks for violations.

10.10. Creating or initiating serious load activity on the infrastructure, including:

  • DDoS attacks;
  • other forms of performance attacks;
  • attempts to interfere with computational processes, bypass security systems, exploit Service vulnerabilities.

Such actions will be stopped, access will be blocked, and if there are legal grounds, information may be disclosed to law enforcement authorities.


11. Breach Access Control and Paid Access to Source Data

11.1.

Breach content (source files, dumps, large data arrays) is blocked by default.

11.2.

Access to source files and extended data:

  • is only possible with an active subscription;
  • is provided using tool limits (credits) and/or daily/monthly quotas established by the plan;
  • may be limited by volume, periods, and frequency to reduce risk of abuse.

11.3.

The Company reserves the right to:

  • limit or prohibit unlocking of specific files, datasets, or segments deemed particularly sensitive;
  • refuse access if there is suspicion of abuse, violation of legislation, or Terms.

11.4.

Any attempt to bypass access control mechanisms (including manipulating limits, using automation for mass downloading, emulating different accounts) constitutes a violation of the Terms and may result in immediate account blocking.


12. API, Keys, and Fair Use

12.1.

Access to the NiamonX API is provided only with a valid API key issued by the Company. You are obligated to keep keys confidential and not transfer them to third parties.

12.2.

Prohibited:

  • automatic extraction of large data volumes beyond plan limits;
  • mass mirroring or resale of datasets;
  • using the key in the interests of third parties without written consent from NiamonX.

12.3.

The Company reserves the right to apply:

  • rate limits;
  • data volume quotas;
  • suspension or revocation of keys for violation of Terms or threat to Service stability.

12.4.

Fair Use Policy: To ensure equal access:

  • minimum interval between requests to the same tool is 10 seconds per account via website and 3 seconds via API interface;
  • additional limits may be established depending on the pricing plan and current load.

Violation of fair use policy may result in temporary or permanent blocking of API keys and/or account.


13. Bug Bounty Programs

13.1.

Use of NiamonX tools for participation in bug bounty programs is ONLY permitted if:

  • the target program (owner of the system being researched) expressly and explicitly permits the use of external OSINT tools and similar instruments;
  • such actions do not violate the rules of the respective program, legislation, or third-party rights.

13.2.

Any:

  • unauthorized scanning;
  • vulnerability exploitation;
  • attempts to access systems without clear written permission from the owner;

are considered violations of the Terms and may constitute criminal offenses.


14. Indexing of Publicly Available Breaches

14.1.

The system indexes only those credentials and other information that were technically publicly available on the internet at the time of collection, without:

  • bypassing authentication;
  • paying for access to stolen data;
  • bypassing technical protection measures (paywall, logins, captcha, etc.).

14.2.

The Company does not purchase or pay for datasets knowingly obtained illegally and does not encourage unauthorized access.

14.3.

Prohibited Categories: We endeavor not to index or use datasets containing predominantly:

  • banking data;
  • medical records;
  • other particularly sensitive categories of personal data if this contradicts applicable law or our internal security policies.

14.4.

If we become aware that a specific dataset:

  • is clearly illegal;
  • was not intended for public access;
  • or violates data subjects' rights;

we will take reasonable measures to remove such dataset or restrict access to it as soon as possible.

14.5.

If you discover:

  • clearly illegal content;
  • or your own data whose access you wish to restrict or remove;

15. Disclaimer of Warranties and Limitation of Liability

15.1. Disclaimer of Warranties

All services, tools, data, and materials are provided "AS IS" and "AS AVAILABLE". NiamonX makes no warranties, express or implied, including but not limited to:

  • warranties of accuracy, completeness, or timeliness of data;
  • warranties of merchantability;
  • fitness for a particular purpose;
  • absence of errors, failures, and vulnerabilities;
  • conformity to your expectations or specific requirements.

15.2. Data Accuracy and Timeliness

The Service administration constantly checks and updates data available through the Service, however:

  • does not guarantee that any information cannot be outdated or inaccurate;
  • results may contain errors, omissions, duplicates;
  • data may be lost due to third-party actions, time, technical limitations.

15.3. Fitness for User Purposes

The Administration is not responsible for the Service's conformity to your goals and expectations, including professional, legal, compliance, audit, or other specific purposes. The Service does not constitute legal advice or expert opinion.

15.4. Limitation of Liability

To the maximum extent permitted by law, NiamonX is not liable for any:

  • direct, indirect, incidental, punitive, special, or consequential damages;
  • lost revenue, lost profits, data loss, business downtime;
  • consequences of using or inability to use the Service;
  • consequences of reliance on information obtained through the Service.

15.5.

Nothing in these Terms excludes or limits NiamonX's liability to the extent such exclusion or limitation is prohibited by applicable law (for example, liability for intentional harm or gross negligence to the extent not expressly permitted by law).


16. User Liability and Risks

16.1.

The User assumes all risks associated with:

  • use of the Service and information obtained through it;
  • choice of security measures for their account;
  • use of analysis results, reports, and data in their professional or other activities.

16.2.

The User bears full responsibility for all actions performed through their account and their consequences, unless they have timely and properly notified NiamonX of unauthorized access and compromise of authentication means.


17. Indemnification

17.1.

You agree to indemnify, defend, and hold harmless NiamonX LTD, its affiliates, directors, employees, agents, and partners from any claims, damages, liabilities, fines, expenses, and costs (including reasonable legal fees) arising from:

  • your violation of these Terms;
  • use of the Service in violation of law or third-party rights;
  • any actions performed through your account for which you are responsible.

18. Termination, Suspension, and Access Blocking

18.1.

The Company reserves the right at any time, wholly or partially, to suspend or terminate access to the Service if:

  • you violate these Terms;
  • there is reasonable suspicion of violation of law or abuse of the Service;
  • your activity poses a threat to the security, stability, or reputation of the Service.

18.2.

We typically notify users by email about suspension or blocking, except when:

  • immediate blocking is necessary to prevent damage;
  • notification may hinder investigation of abuse or violations.

18.3.

Termination of access due to violation of the Terms does not entitle to a refund for the already paid period, except in cases expressly provided by law.


19. Changes to the Terms

19.1.

The Company reserves the right to periodically modify these Terms. The updated version becomes effective from the moment of its publication on the website, unless otherwise expressly stated.

19.2.

In case of material changes, we may notify users through the Service interface and/or by email, if technically feasible.

19.3.

By continuing to use the Service after the changes take effect, you confirm your agreement to the updated Terms. If you do not agree, you must cease using the Service and, if necessary, request account deletion.


20. Governing Law and Jurisdiction

20.1.

These Terms are governed by and construed in accordance with the laws of England and Wales, excluding conflict of law provisions referring to the laws of other jurisdictions.

20.2.

All disputes arising from or related to these Terms are subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise provided by mandatory provisions of applicable law.

22. Final Provisions

22.1.

These Terms constitute the entire agreement between you and NiamonX regarding use of the Service and supersede all prior agreements or understandings on this subject (except for separate written agreements with corporate clients).

22.2.

If any provision of these Terms is held invalid or unenforceable by a competent court, the remaining provisions shall retain full legal force and effect. The invalid provision shall, where possible, be deemed modified to the extent necessary to make it legally valid.

22.3.

Failure or delay by NiamonX in exercising any right or remedy under these Terms shall not constitute a waiver of such right or remedy and shall not preclude its subsequent exercise.
